Terms of Service

1. Acceptance of Terms

By accessing or using LinkPulse (the "Service"), provided by Bussa Alessandro under the business name LinkPulse Media, a sole proprietorship based in Sassari, Italy, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the Service.

2. Private Beta Status

LinkPulse is currently offered as an invite-only Private Beta. As experimental software:

  • The Service may contain bugs, errors, or inaccuracies.
  • Features and functionality may be modified, suspended, or discontinued at any time without notice.
  • Availability and uptime are not guaranteed.
  • Account limits, rate limits, and access constraints may apply and change at our discretion.

3. Account Eligibility and Security

Access to the Service is strictly by invitation only. You may not share your account credentials or attempt to bypass our authentication or rate-limiting mechanisms. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use and Restrictions

You agree to use the Service only for lawful purposes. You explicitly agree NOT to use LinkPulse to:

  • Send spam, unsolicited abusive bulk email, phishing attempts, or malware.
  • Engage in illegal tracking, fraud, impersonation, or credential theft.
  • Circumvent any rate limits or security mechanisms we deploy.
  • Perform abusive automated scraping or unlawful personal-data collection.

5. Email and Outreach Responsibility

LinkPulse provides tools to assist in manual email outreach. LinkPulse is not a mass-mailing platform. All emails sent via your connected Gmail account are manually initiated by you.

You are solely responsible for ensuring that your outreach complies with all applicable anti-spam and privacy laws (e.g., CAN-SPAM, GDPR). You must have a lawful basis or appropriate permission to contact your recipients where required by law.

6. AI Disclaimer

Our Service includes features powered by artificial intelligence (AI). AI-generated suggestions, including strategies and content, may be inaccurate, inappropriate, or ineffective. You must manually review and approve all AI-generated content before use. We provide no guarantee of SEO performance, outreach success, or any specific business outcomes resulting from your use of the Service.

7. Tracking Links

When utilizing our tracking link functionality, you must ensure that your use complies with all applicable regulations regarding data collection and user consent. We reserve the right to suspend or disable tracking links that we determine, in our sole discretion, violate these Terms or pose a security risk.

8. Third-Party Services

The Service integrates with third-party providers (e.g., Google Workspace, Gemini, Hunter, Tavily). Your use of the Service is also subject to the availability and terms of these third parties. We are not responsible for the performance or policies of these external providers.

9. Intellectual Property

LinkPulse retains all right, title, and interest in and to the Service, including all software, design, and intellectual property. You retain ownership of the data and content you input into the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSSA ALESSANDRO (LINKPULSE MEDIA) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

12. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms or usage that negatively impacts our infrastructure.

13. Governing Law

These Terms are governed by the laws of Italy, without prejudice to any mandatory protections that may apply under applicable law.
